1. General handling of your data
1.1. We comply strictly with the applicable data protection legislation.
1.2. In principle, we do not collect or save any of your personal data when you visit the Capri-Sun-AG -website. This happens far more only in situations where we have expressly asked you for personal details in advance. For example, if you enter a competition you will be asked for your name and address so that we can contact you if you are a winner. The Capri-Sun-AG -website also has a personal area where you must register, and certain personal data must be saved for you to take part; see section 2 of this data protection statement for more details.
1.3. Otherwise, our server will save only anonymous data during your visit to the Capri-Sun-AG -website which are usually technically recorded when access websites: the name of your internet browsers, the name of your Internet Service Providers, the IP address from which your computer makes the internet connection, the name of your operating system, which of our websites you have visited, as well as the date and duration of your visit. This data is saved temporarily in protocol files and then deleted automatically. Data is saved so that if there is a problem, the activities which may have led to the disruption can be analysed.
2. What data do we collect, and why?
We use the data collected to provide you with a constant standard of personal service. We use your data only in the way described in this statement or as specified when we record the data. Any subsequent change to the intended use is subject to your express consent, unless said change is otherwise justified by applicable legal provisions.
We process data provided to us voluntarily, such as:
Salutation, title, gender, first name, surname, company, position, street and house number, postcode and town, e-mail address, telephone number for the following purposes, among others:
• To process product orders and deliveries;
• To inform you about product announcements and special offers etc. In some cases, this may include information from other companies and business partners, provided their products add benefit to our products;
• To tailor information precisely to your needs. For example we can provide you with information about the products that interest you;
• So that we can contact you, respond to customer enquiries and advise you regarding dispatch and invoicing issues;
• To carry out voluntary customer surveys so that we can continually improve our services and products; To process enquiries about vacancies, online applications;
• To fulfil contractual obligations;
• To process the contact and registration form;
• To enter competitions;
• To receive our newsletter.
3. Orders and registering for events
Our Capri-Sun-AG-website contains order forms which you can complete to request information, products and services. Payment information is also recorded via these forms, such as your bank details or credit card numbers. This data is used only to process invoices and payments for the specific process. Where necessary, processing will include passing your data to third parties such as banks, credit card companies or other financial and credit institutions involved in carrying out the process.
4. Passing on your personal data
Information which you enter on our Capri-Sun-AG -website may therefore be passed to a server in this or in another country. Your private domain is protected globally because all our websites are subject to the data protection guidelines described here.
We process your data worldwide within our company so that we can deal with your enquiries and orders and further improve our services and products. If necessary, information is also passed to business partners, service providers, third parties, or sub-contractors. This may be necessary so that we can deliver the service or complete the transaction you require, such as processing your order, credit card payments, for customer service purposes or to inform you about services or products.
When we pass your personal data to third parties, we restrict it to such information as is necessary to deliver the services in question. The third-party provider is permitted to use this personal data only to deliver the service requested or to complete the necessary transaction.
Your personal details will not be passed on, sold or otherwise made available for marketing purposes without your prior consent.
Our organization may be required to disclose your data and associated information by court order or official request. We also reserve the right to use your data to establish or defend legal claims.
In the event of a takeover or merger with another company, the disclosure or transfer of personal data to potential or actual buyers may be necessary. In this eventually, we will seek to maintain the highest possible level of protection of your data.
In accordance with the applicable legislation, we reserve the right to store and pass on personal and other data to expose and combat illegal activities and attempted fraud or any breach of the terms and conditions of use.
5. Security of personal data
Our main concern is the protection of your personal data. In order protect personal data effectively against unauthorized access, misuse or disclosure, we use standard security processes and technologies. This includes the use of Secure Server Technology and other state-of-the-art processes to prevent abuse. We also require each of our employees to protect data and act confidentially, pursuant to § 5 of the German Federal Data Protection Act (BDSG).
The protection of your personal data is important to us. To protect personal data effectively against unauthorised access, misuse or disclosure, Capri Sun AG takes technological and organisational security measures so that the data you provide is protected against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security measures are continually improved in accordance with technological developments. In the event that personal data is collected and processed, the information will be transferred unencrypted. For this reason, please provide as little personal data as possible.
Additionally, we require each of our employees to submit an undertaking to protect data and maintain confidentiality in line with the General Data Protection Regulation.
6. Cookies on our web server
6.1. Our web server uses so-called Cookies. Cookies are small text files which are saved on your computer, provided your internet browsers settings allow them. Cookies are a very common technology used by very many websites. As text files, Cookies cannot harm your computer.
6.2. In detail, our web server uses the following Cookies:
6.2.1. At the start of your visit to the Capri Sun AG -website, our web server installs a Cookie on your computer to distinguish your access from other users who are accessing the site at the same time. This Cookie is deleted automatically as soon as you close down your internet browser.
6.2.2. As soon as you enter information into a window which appears on the Capri Sun AG -website, our web server saves, where applicable, a Cookie on your computer so that the same window does not appear the next time when you visit our website. This Cookie is also deleted after a certain period of time.
6.3. The majority of internet browsers are set up at first to accept Cookies.
6.4. If, in general, you wish to prevent our web server from saving Cookies, you can deactivate Cookies by going to your internet browser settings. However please note: If you have deactivated Cookies in your internet browser, you may not be able to visit or use all the pages or functionalities of the Pouch- Capri Sun AG without problems.
You can deactivate cookies at any time by changing the cookie settings.7. Links with social networks
7.1. Some of the pages of the Capri Sun AG-website at times contain special programs on certain pages (so-called ‘plug-ins’) which are able to create a link to social networks such as Facebook, Google+ or XING. You can recognize each of these plug-ins from the button with the respective social network logo.
7.2. These plug-ins do not become active unless you click on them. You will know that you have activated them because the appearance of the plug-ins will change. Following activation, the plug-ins collect, process and use data as follows:
7.2.1. As soon as you activate a plug-in, it creates a brief connection from your internet browsers to the social network’s server and the content of the plug-in is transferred from there to your internet browser.
This means that the social network operator will know your IP address. In certain circumstances, the social network operator will also try to save a Cookie on your computer, which will also be deleted when you close down your internet browser. If at the same time you are logged in to the social network site whose plug-in you have activated on a Capri Sun AG -website, information about your visit to the Capri Sun AG -website may be matched to your user account, and saved, processed and used by the social network operator.
If you use a plug-in, e.g. by pressing the plug-ins button again following activation or by sending a text via plug-in, the corresponding information will be sent from your internet browser to the social network operator and saved by this operator.

For Twitter plug-ins in particular our website may use social plug-ins from the social network Twitter, which are provided and operated by Twitter, Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA (hereinafter: ‘Twitter’). 7.3. The Capri Sun AG -website contains links to the social network www.facebook.com. You can use the page only if you have a Facebook user account and are logged into it. 8. Google Analytics web analysis service
8.1. Capri Sun AG -website uses Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: ‘Google’).
8.2. Google Analytics saves a permanent Cookie on your computer, provided your internet browser settings permit this. This permanent Cookie can be read again when you next visit Capri Sun AG -website. To prevent this, you can delete the permanent Cookie in your internet browser settings following your visit to the Capri Sun AG -website. The Google Analytics Cookie allows the analysis of your use of Capri Sun AG -website.
8.3. The information generated by the Cookie referred to under point 5.2 with respect to your use of Capri Sun AG -website is generally transmitted to a Google server in the USA and saved there. To protect your private domain, your IP address is abbreviated before being transmitted. This abbreviation is carried out by Google within the Member States of the European Union or in other Contracting States to the Agreement on the European Economic Area. Only in exceptional circumstances your full IP address will be transmitted to a Google server in the USA and abbreviated there.
8.4. Google uses the data transmitted to Google by Google Analytics concerning your use of Capri Sun AG -website on our instruction to evaluate your use of the Capri Sun AG -website , to compile reports about website activities on the Capri Sun AG -website and to provide us with additional services associated with the use of the Capri Sun AG -website and internet use. The IP address transmitted from your internet browser under Google Analytics is not synchronised with other Google data.
8.5. Should you not agree with the Google Analytics processes and functions , you can disable Cookies. However this may result in the disruptions during your visit to Capri Sun AG .
Rather than deactivating or deleting Cookies, you can also download and install the Google browser add-on to deactivate Google Analytics. If you do not wish for Facebook to be able to match your visit of our website with your Facebook account, please log out of your Facebook account.
10. E-mail newsletter
10.1. You can subscribe to e-mail newsletters on Capri Sun AG -website. However we will send e-mail newsletters to your e-mail address only with you express prior consent.
You grant us this consent – which may be revoked at any time – by entering your e-mail address in the field for agreeing to the newsletter and by confirming the following text by activating a click box: “Yes, I would like to receive Capri Sun AG newsletter by e-mail so that you can tell me about the latest innovations and campaign. I can unsubscribe from the Capri Sun AG newsletter at any time by clicking on the unsubscribe link in the newsletter.”
10.2. We use a Double-Opt-In process when you subscribe to a newsletter to protect you from other people subscribing to the e-mail newsletter using your e-mail address. This means that: after you have subscribed to the newsletter, you will receive an e-mail asking to re-confirm your subscription. Your newsletter subscription will become active only after you have re-confirmed your subscription.
10.3. You can stop receiving an e-mail newsletter at any time thus revoke your consent to the content of the newsletter. To stop receiving the newsletter, please use the unsubscribe link in the e-mail newsletter.
10.4. Our e-mail newsletters may contain so-called tracking pixels which may also be called Clear Gif or Web Beacon. These are transparent individual graphic pixels which are integrated within the e-mail newsletter. Provided the newsletter recipient’s e-mail program allows graphics to be loaded, we can use these tracking pixels to assess how many of our newsletter e-mails have reached their recipient. This data is anonymous, and we use it for statistical purposes only. It is not assigned to you as an individual. Not even your IP address is passed to us.
You can disable tracking pixel functions by setting your e-mail program so that is does not load graphics. However this may result in our e-mail newsletter not being displayed in full.
10.5. We also record statistically how often the addressees of our e-mail newsletter have activated the links in the e-mail newsletter. This is also an anonymous process and this data is not assigned to the recipients of our e-mail newsletter. Your IP address is not passed to us when we record this data.
We hold competitions on the Capri Sun AG -website from time to time. The personal details which we take from you when you enter a competition are used only for the purpose of the competition – and only with your express prior consent.
You give us this consent – which you may withdraw at any time – by confirming the following text by activating a check box for each competition: “I agree that Capri Sun AG may save and use the details I have provided here for the purposes of the competition. I may withdraw this consent at any time by sending an e-mail to firstname.lastname@example.org However should I withdraw my consent, my entry in the competition will also be withdrawn.”
12. Right to access, rectification, erasure and restriction of processing
You have the right at all times to obtain information about and access your personal data that we have saved as well as the right to have the processing of this data restricted or the data erased, and in all instances at no cost. You have the right to review and rectify all personal data concerning you that we have saved if you believe that it is old or incorrect. 13. Right to withdraw consent
You are entitled at any time to withdraw your consent to the use of your personal data with future effect. Sending an email to the email address below is sufficient for this purpose.
14. Deletion of data
If an application you file online is rejected or unsuccessful, the data you provided in the application will be deleted as soon as the application process ends. This does not apply if you have consented to a longer storage period or if the data cannot be deleted in line with the statutory provisions. You can withdraw your application at any time by sending an email to email@example.com.
The Capri-Sun-AG -website does not currently allow users to permanently delete or deactivate their details from our database, however we will do this for you on request. If you wish to permanently delete or deactivate your details from our database or to remove your name from a mailing list, please send an e-mail to firstname.lastname@example.org
Data deletion when you submit an online application.
Data which you submit as part of an online application will be deleted immediately following the application process if you are rejected or the decision is negative. If, contrary to legal provisions, you have consented to your data being saved for a longer period, this does not apply. You may withdraw your application at any time by sending us an e-mail to email@example.com
15. Data retention
Capri Sun AG retains personal data only for such time that it is required for the purpose or as legal provisions demand.
